TCPA Disclosures
Express Written Consent
Every lead submitted through a FundingSourced web form includes express written consent. The following data points are captured server-side at the moment of submission: timestamp, IP address, user agent, and the exact version of the consent text displayed.
“By submitting, I consent to be contacted by FundingSourced and its funding partners by phone, SMS, and email at the number/address provided, including by autodialed/prerecorded means, even if my number is on a do-not-call list. Consent is not a condition of any service. Message and data rates may apply.”
Buyer Obligations
Buyers must honor opt-out requests immediately upon receipt. No contact may be made outside of 8:00 AM to 9:00 PM in the merchant’s local time zone. Buyers must maintain their own internal do-not-call lists and are responsible for obtaining their own consent for any subsequent re-contact beyond the initial outreach covered by the original submission consent.
Affiliate Intake
Affiliates posting leads to /api/v1/leads/intake must include consent=true along with the required metadata fields (IP, user agent, timestamp, consent text version, source URL). Affiliates are contractually liable for the validity of the consent they represent.
Audit Trail
On written request, FundingSourced will produce the following records for any lead: the consent text displayed, the submitting IP address, the user agent, the timestamp of submission, the consent text version identifier, and the source URL. Audit requests should be directed to legal@fundingsourced.com.
Opt-Out
Merchants may opt out of communications at any time by replying STOP to any SMS message, clicking the unsubscribe link in any email, or emailing optout@fundingsourced.com. All opt-out requests are honored within 10 business days.
